Terms of Service

By engaging Mtshwene Multimedia ("we", "us", "our") for any service, you ("the Client") agree to the following terms. Please read them carefully before proceeding.
1. Services
Mtshwene Multimedia provides website development, web application development, and related digital services as described on our website and confirmed in individual project proposals or agreements. The scope of work for each engagement is agreed upon in writing before work begins.
2. Subscription Plans
Our website subscription plans include an upfront build fee and an ongoing monthly or yearly maintenance and hosting fee. The upfront fee covers the initial design and development. The recurring fee covers:
- Website hosting and SSL certificate
- Security monitoring and maintenance
- Content updates as specified in your plan
- Ongoing technical support
Subscription fees are billed in advance. Failure to pay will result in suspension of hosting services after a 7-day grace period.
3. Cancellation
You may cancel your subscription at any time by notifying us in writing at info@mtshwenemultimedia.com. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.
Upon cancellation, we will provide you with all your website files, assets, and content within 14 business days. Your domain remains yours and will not be affected.
4. Ownership & Intellectual Property
Upon receipt of full payment of the upfront build fee, all custom code, designs, and content created specifically for your project become your property. We retain the right to display the work in our portfolio unless you request otherwise in writing.
Any third-party assets used (fonts, stock images, plugins) remain subject to their respective licences. We will inform you of any such assets used in your project.
5. Client Responsibilities
You agree to:
- Provide all necessary content (text, images, branding materials) in a timely manner
- Review and approve deliverables within the agreed timeframes
- Ensure that any content you provide does not infringe on third-party rights
- Pay all invoices by their due dates
6. Project Timelines
Estimated timelines are provided in good faith and are dependent on timely receipt of content and feedback from the Client. Delays caused by the Client may extend the project timeline without penalty to Mtshwene Multimedia.
7. Limitation of Liability
Mtshwene Multimedia will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the services provided. Our total liability in any matter is limited to the amount paid by the Client in the three months preceding the claim.
8. Revisions & Change Requests
Each plan includes a defined number of monthly updates. Requests exceeding your plan allowance will be quoted separately and require written approval before work begins.
9. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved under the jurisdiction of the South African courts.
10. Changes to These Terms
We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated terms. We will notify active clients of material changes via email.
